Fixed-term contract: is an exception really applicable?
Since 1 July 2024 most new rental contracts must be for an indefinite period. A fixed end date is allowed only in specific situations, such as students renting temporarily for their studies.

Deposit looks higher than the legal maximum
For contracts concluded from 1 July 2023 the deposit may be at most two months of base rent (rent without service costs).

Agency fee charged to the tenant
Agents who work for the landlord cannot charge you agency fees, whoever pays them in the end. Fees may be disguised as administration, registration or contract costs.

Contract, key money or similar one-off charges
You do not pay the landlord for drawing up the contract, and key money is not allowed. Other landlord costs are only allowed when you get something in return.

Rent increase clause above the legal cap or more than once a year
Rent can go up only once per 12 months and never above the legal maximum for your segment, even if the contract says otherwise.

Landlord may terminate without a legal ground or with short notice
A landlord cannot end an ordinary rental contract just because they want to. They need a legal ground and must give 3 to 6 months' notice.

Tenant notice period longer than the legal maximum
A tenant never has to give more than 3 months' notice, and for monthly rent it is normally one month.

Deposit return period looks too long or missing
The deposit should come back within 14 days after the end of the tenancy, or within 30 days for the remainder when there are deductions.

Deductions from the deposit that are not on the permitted list
Only four kinds of costs may be deducted from a deposit: overdue rent, service costs, damage that is for the tenant's account, and the energy performance fee.

Temporary contract longer than 2 years or without a clear end date
Temporary contracts for the listed groups run for at most two years and must have an end date. Other legal bases can differ.

Service cost statement missing or too late
Service costs are an advance payment. The landlord has to send the actual-cost statement for a year before 1 July of the next year.

Starting rent may be checkable (points system) and the 6-month window
Depending on its quality points, your home may have a legal maximum starting rent. You can check it yourself and, if needed, ask the Huurcommissie within 6 months of the start.
